Terms & Conditions Welcome to Luupo Pet Sitting!

WHAT PARTS OF THESE TERMS APPLY TO ME?

This agreement governs your use of the Luupo Pet Sitting platform (Platform) and any other services made available through the Platform. By using the Platform, you agree to be bound by this agreement which forms a binding contractual agreement between you, the User, and us, Luupo Pet Sitting (Luupo, we or us).

The remainder of this agreement is divided into three parts: Part A (All Users), which sets out terms that apply to all Users; Part B (Sitters), which sets out additional terms that apply to Sitters, being individuals who offer Pet Sitting Services to care for the Homes and pets of Owners while they are away; and Part C (Owners), which sets out additional terms that apply to Owners, being individuals that own residential properties and seek to engage Sitters for Pet Sitting Services.

If you intend to use the Platform as a Sitter, only Part A and Part B of these terms will apply to you. If you intend to use the Platform as an Owner, only Part A and Part C of these terms will apply to you.

When we talk about the "Services" in this agreement, we are referring to the services available through our Platform and any associated services we offer. "Home" refers to the Owner's residential property where the Pet Sitting Services will be provided.

"Pet Sit Arrangement" means the agreement between an Owner and a Sitter for the provision of Pet Sitting Services, which may arise from either the acceptance of an Owner Ad by a Sitter or the direct request by an Owner to a Sitter to provide Pet Sitting Services via a Sitter's Profile. This arrangement includes the terms and responsibilities agreed upon by both parties regarding the care of the Home, pets, and any other specified duties.

"Pet Sitting Services" refers to the services provided by Sitters, which may include caring for the Home, pets, and other responsibilities as agreed between the Owner and the Sitter.

"Owner Ads" refers to requests for Pet Sitting Services submitted to the Platform by Owners, outlining their specific needs, dates, and requirements for Sitters.

"Owner Agent" refers to an individual or entity designated by the Owner to act on their behalf in matters related to the property, including authorizing repairs and communicating with the Sitter.

"Vehicle" refers to a motor vehicle owned by the Owner that may be used by the Sitter during the pet sitting period as specified by the Owner.

If you access or download our mobile application from the Apple App Store or Google Play Store, you agree to Apple's Licensed Application End User License Agreement and any Usage Rules set forth in the App Store Terms of Service or the Android, Google Inc. Terms and Conditions including the License Agreement and Terms of Application.

We may use Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

Part B – Sitters COMMUNICATION WITH OWNERS 1.1 GENERAL (a) By purchasing a Luupo membership, you may respond to Owner Ads. (b) When engaging in a Pet Sit Arrangement, you acknowledge and agree: (i) all terms including duties and any agreed payment must be settled between you and the Owner. Luupo pet sits are generally based on a free exchange. (ii) once you accept an arrangement, you agree to fulfil all aspects of the Pet Sitting Services unless extenuating circumstances arise. (iii) disputes must be handled in accordance with this agreement. (iv) any additional agreements must not contradict Luupo’s terms. (v) Luupo is not responsible for the accuracy or timing of Owner responses or Ads.

1.2 CONFIRMING AND MANAGING PET SITTING SERVICES (a) Once an arrangement is agreed, it should be confirmed through the Platform. Either party may initiate confirmation. (b) Amendments and cancellations: (i) Owners may change suburb or dates with agreement. (ii) Either party may cancel due to emergencies or similar.

PROVISION OF PET SITTING SERVICES (a) Sitters must: (i) perform all agreed services professionally and on time. (ii) comply with all laws and care instructions. (iii) ensure pets, homes, and any vehicles are properly looked after. (iv) not misrepresent themselves or their capabilities. (b) Sitters warrant: their profile is truthful and includes an appropriate photo. they will not include personal contact info in their profile. they have no serious criminal history. they will be responsible for damages due to neglect. they will follow pet care and maintenance agreements. they will not sublet or invite guests without permission. they will lock and secure the property. they will not invalidate insurance policies. they will report issues or emergencies to the Owner Agent. (c) Sitters must confirm any use of the Owner's vehicle and follow all legal and agreed terms.

DISCLAIMER – PETS (a) Sitters are not required to accept pet-related arrangements. (b) Sitters accept all risks associated with caring for animals. (c) Sitters may decline to continue a sit if the pet differs materially from what was described. (d) Sitters are not responsible for pet-related costs unless explicitly agreed. (e) Issues must be reported to the Owner immediately. (f) Luupo is not liable for any injuries, incidents, or damage involving pets. MEMBERSHIP (a) Sitters must hold a valid, paid membership to access platform features. (b) Memberships are valid for 12 months unless otherwise specified. (c) Memberships do not auto-renew and are non-refundable unless otherwise required by law.

FEES (a) Membership and verification fees are payable in advance and are non-refundable for change of mind. (b) The Platform may use third-party payment providers. (c) Changes to fees will be communicated with notice. (d) Luupo is not responsible for any pet sitting fees agreed privately between Sitters and Owners.

REFUNDS & CANCELLATIONS (a) Cancellations should be communicated directly to the other party. (b) Luupo is not responsible for facilitating or resolving refund disputes.

CONTACTING ON BEHALF OF THIRD PARTIES Sitters may not contact Owners on behalf of agencies or other people. All communication must be direct and personal.

LINKED BUSINESSES (a) Luupo links Users to one another but does not endorse or guarantee any party. (b) Luupo is not involved in any arrangements between Owners and Sitters beyond hosting the Platform.

Part C – Owners OWNER RESPONSIBILITIES AND WARRANTIES (a) You must ensure that any Sitter is over 18 years old. (b) You must maintain adequate insurance for your home and contents that covers a Sitter residing in your property. (c) If you are a tenant, you must obtain written consent from your landlord or property manager before engaging a Sitter. (d) It is your sole responsibility to vet any Sitter before confirming a Pet Sit Arrangement. (e) Luupo is not responsible for cancellations or associated costs like travel expenses. (f) Owners must not charge rent to Sitters under any circumstances. Utility contributions may be agreed in writing. (g) You may only post Ads or contact Sitters for your own property. (h) No one else (e.g. flatmates or family members) may reside in the house during the pet sit. (i) If you require caretaker or Airbnb-style duties, this must be clearly agreed and appropriate compensation offered. (j) Your Home must be safe, secure, and clean. (k) If your property has security or pet cameras: (i) you must disclose them and their locations before the sit begins; and (ii) all internal and pet monitoring cameras must be turned off for the duration of the sit. External security cameras may remain on. (l) You must ensure all bills, taxes, and emergency service levies are paid and up to date. (m) You must ensure all appliances, fittings, and smoke alarms are in working order before the sit begins. (n) You are responsible for wear and tear repairs; the Sitter is only liable for damages from neglect. (o) If the Sitter is permitted to use your vehicle: (i) the vehicle must be roadworthy and insured; (ii) you must provide all registration and insurance details; (iii) you must disclose any issues, restrictions, or fuel types; (iv) the tank must be full at the start of the sit (unless otherwise agreed).

DISCLAIMER – PETS (a) If pets are included, you must provide accurate, complete information about their behaviour, care needs, medical requirements, and risks. (b) You must not include pets that pose a known risk to Sitters. (c) You are responsible for all costs relating to the pet, including food, vet bills, and medications, unless otherwise agreed. (d) You are liable for any injury, damage, or loss caused by your pet. (e) Sitters are not required to accept pet-related sits and may decline or withdraw if the pet situation is misrepresented. (f) You must comply with pet-related laws, including vaccinations, registrations, and containment rules. (g) You must remain contactable during the sit to provide pet-related instructions if requested. (h) Luupo is not liable for any issues arising from your pet’s behaviour.

PET SIT ARRANGEMENTS – OWNER ADS AND CONTACT 3.1 GENERAL (a) When posting an Ad or messaging a Sitter, you must: (i) be truthful and accurate; (ii) include location, dates, pet and garden needs, stairs, pool, vehicle use, photos, and utility contributions (if any); (iii) not misrepresent or withhold critical information. (b) Once a Pet Sit Arrangement is agreed: (i) it is a binding contract between you and the Sitter; (ii) the confirmation should be completed via the Platform; (iii) any terms must not contradict Luupo’s terms. 3.2 CONFIRMING AND MANAGING PET SITTING SERVICES (a) Either party may initiate confirmation through the Platform, triggering an automated email to the other party. (b) Amendments and cancellations: (i) suburb and dates may be changed with mutual agreement; (ii) cancellations should only occur for serious unforeseen reasons. (c) Reply Ratings apply: (i) Users must reply within 5 days; (ii) failure to respond reduces your score; (iii) timely responses restore your score. (d) The Platform will send reminders to encourage communication. MEMBERSHIP (a) To contact Sitters or post Ads, you must sign up for a free owner membership.. (b) If you wish to also sit for others, you must purchase a separate Sitter membership. (c) Membership fees are non-refundable for change of mind.

FEES 5.1 MEMBERSHIP FEES (a) Membership and verification fees are paid upfront and are non-refundable for change of mind. (b) 5.2 PET SITTING FEES (a) Pet Sitting Services are usually unpaid and based on mutual benefit. (b) If any payment is agreed, it must be clear in the Ad or discussed directly.

CANCELLATIONS (a) Luupo is not liable if a Sitter cancels after confirming a Pet Sit Arrangement. (b) If you cancel, you must contact the Sitter directly and cooperate with any investigation if required.

LINKED BUSINESSES (a) Luupo introduces Owners to Sitters but does not control or endorse them. (b) We are not involved in the agreement beyond providing the Platform.
